An organisaton is guilty of Corporate Manslaughter if the way in which its activities are managed or organised causes a death and amounts to a gross breach of a duty of care to the person who died.
The HSE and HSENI have issued guidance in relation to Lone Workers .i.e. those who work alone or become isolated in their workplace. Failure to risk assess and resultant injury could attract liability under the Corporate Manslaughter legislation and under the new Health and Safety Offences Act 2009 which permits the sanction of imprisonment under 16 sections (formerly 2 sections) of the Health and Safety Act 1974 and the Health and Safety at work NI Order 1978.
